At hotel scale, NTB registration stops being a cost question, the fee caps make a 60-room hotel's statutory bill a rounding error on the project, and becomes a sequencing question inside a larger development timeline. The classification turns on one word the smaller classes don't use: en-suite. Count your en-suite rooms and the regulations place you; miss the threshold and you've registered the wrong business. And the enforcement backdrop is the same as for a two-room B&B: operating unregistered risks up to N$20,000, two years' imprisonment, or both.

The En-Suite Thresholds: Pension, Hotel, Resort

  • Hotel pension, 10 to 20 en-suite bedrooms. The class built for the converted large residence or small city property.
  • Hotel, 20 or more en-suite bedrooms, with the full commercial expectations that implies.
  • Resort, a property combining three or more classes with 40+ rooms (25+ en-suite): its own registration with higher fee caps and genuinely project-managed compliance.

The word doing the work is en-suite. Twelve rooms sharing four bathrooms is not a hotel pension, it's a guest house, whatever the signage says. If a refurbishment is adding bathrooms anyway, crossing the en-suite threshold deliberately can be worth it: the hotel classes carry more commercial weight with graded-market buyers and corporate accounts. The Fee Caps (Why Big Properties Register Cheap)

The per-room arithmetic, N$200 application + N$50 registration per room, hits statutory caps at N$8,000 and N$2,000 (N$12,000 and N$3,000 for resorts):

Business Zoning and the Development Chain

Unlike the B&B's consent-use shortcut, hotel-scale operations need business rights on the erf, existing business/office zoning, or a rezoning as part of the development. For a new build, the compliance chain is the development programme:

  1. Zoning/rights confirmed or amended, before design freezes;
  2. Environmental screening where triggered (greenfield sites, sensitive locations, the same ECC logic as lodges);
  3. Approved building plans and construction sign-offs;
  4. Fitness and fire at commercial scale, Windhoek's hotel/lodge Certificate of Fitness tariff is N$3,615.98 (2025/26), and the fire file for a multi-storey building is a design document, not a checklist item;
  5. NTB lodgement, inspection, certificate, with the statutory notices displayed and the 2% levy live from the first guest folio.

The Commercial Inspection

Everything the guesthouse inspection checks, at commercial scale and staffing levels: full commercial-kitchen compliance with medicals for the entire food brigade, laundry and refuse systems, staff facilities, and fire systems appropriate to the building class. Two practical notes from the trenches: run the pre-inspection walkthrough with your heads of department, because findings usually land in their areas; and schedule the fitness and fire visits before soft-opening dates are printed on anything.

Conference Facilities, Restaurants and Shuttles

  • Conference facilities marketed commercially are their own regulated class, conference centre, N$2,200 + N$200, registered alongside the hotel with the combination discount (100% / 50% / 25%).
  • The airport shuttle is a shuttle/transport registration with the Road Carrier Permit, PrDP drivers and N$5 million passenger cover, start the RCP with the pre-opening critical path, not after.
  • The restaurant serving non-residents sits under the municipal health regime within your CoF scope, flag it in the fitness application so the inspection covers it once, not twice.

We have 18 en-suite rooms and 4 with shared bathrooms. Which class are we?

The en-suite count places you: 18 en-suite rooms sits in hotel pension territory (10–20), and the shared-bathroom rooms don't count toward a hotel claim. Whether to market and register the 4 as part of the establishment is a classification conversation worth having before lodgement, mixed configurations are exactly where files bounce.

Do the NTB fee caps apply per property or per entity?

Per registration, each establishment registers on its own application with its own fee. A group operating three hotels holds three registrations; the combination discount applies to multiple classes on one establishment, not multiple properties.

Our hotel is trading under new ownership, is the old registration still good?

Is star grading required at hotel scale?
