What Is Employment Equity in Namibia?

Employment equity in Namibia is governed by the Affirmative Action (Employment) Act No. 29 of 1998. The Act requires designated employers to implement affirmative action policies that promote equal employment opportunities for previously disadvantaged Namibians.

Who Must Register?

You are a designated employer required to register if your business:

  • Employs 25 or more employees, OR
  • Has an annual turnover above the threshold set by the Employment Equity Commissioner.

Designated employers must register with the Employment Equity Commissioner, prepare an Affirmative Action Plan, and submit it for approval.

Why Does This Matter for Tenders?

Most government tender applications require an Employment Equity Compliance Certificate (or "Good Standing" letter from the Employment Equity Commissioner). Without it, tender bids are typically disqualified at the compliance check stage.

What Must a Designated Employer Do?

  • Register with the Employment Equity Commissioner's Office.
  • Conduct a workforce audit to identify the current composition of staff.
  • Prepare and submit an Affirmative Action Plan within six months of becoming a designated employer.
  • Implement the plan — this includes setting targets for the promotion and hiring of previously disadvantaged persons.
  • Report annually on progress made against the plan.

What Happens If You Dont Comply?

Non-compliant designated employers face penalties and may be ordered by the Labour Court to implement affirmative action measures. More immediately, non-compliance disqualifies you from government tenders and procurement opportunities.
